Privacy PolicyBack to top

These Terms of Use (“Terms”) govern your access to and use of the SnapCount app for iPhone and iPad and its related services, including this website (together, the “Service”), provided by Nexdev (“Nexdev”, “we”, “us”). Please read them carefully, together with our Privacy Policy.

At a glance

A short summary. The full Terms below are what apply.

  • AI counts are estimates. A count can miss objects or include the wrong ones, so check it yourself when the exact number matters.
  • Counting requires SnapCount Pro. Pro is a weekly or yearly subscription that renews automatically until you cancel it in your App Store settings.
  • Your photos stay yours. You let us process them only to run SnapCount.
  • For adults. You must be at least 18 years old to use SnapCount.

01Acceptance of These Terms

Link to section: Acceptance of These Terms

By downloading, accessing or using SnapCount, you agree to these Terms. If you don’t agree, don’t use the Service.

Age requirement

You must be at least 18 years old, and old enough to enter into a binding contract where you live, to use SnapCount. The AI services that power SnapCount are intended for adults. The app’s App Store age rating describes its content, not its intended audience.

Your licence to use the app

If you downloaded SnapCount from the Apple App Store, your licence to use the app is governed by Apple’s Licensed Application End User License Agreement (“Standard EULA”). These Terms add to the Standard EULA. If they conflict, the Standard EULA applies to your licence to the app, and these Terms apply to everything else about the Service.

02The SnapCount Service

Link to section: The SnapCount Service

SnapCount counts objects in your photos using artificial intelligence. For each count, the Service may show the total, a numbered marker on each counted object, separate counts and colors for different types of objects, a confidence score, whether the count is exact or an estimate with a range, notes on photo quality with tips for retaking it, and a general counting guide for the object.

SnapCount also lets you keep a history of your counts, organize them in collections, add notes, search them, share a text summary and export counts to an Excel (.xlsx) file.

We use service providers, including third-party AI providers, to deliver the Service, as described in our Privacy Policy.

03AI Counting Disclaimer

Link to section: AI Counting Disclaimer

AI counts are estimates, not certified counts

SnapCount’s results are generated by artificial intelligence and may be incomplete, inaccurate or wrong. This includes the number of objects, which objects were counted, the type and color groups, ranges, confidence scores, quality notes and counting guides. Don’t treat any result as a certified count, measurement, audit or expert opinion.

Results depend on photo quality, lighting, angle and distance, how much of each object is visible, and how closely objects overlap or are stacked. Small, crowded, hidden or similar-looking objects can be miscounted, and objects that aren’t visible in the photo can’t be counted. Numbered markers and confidence scores help you check a result; they don’t guarantee it.

Don’t rely on SnapCount alone for

  • medication, dosage or any other health decision, such as counting pills;
  • safety-critical checks, such as making sure every part, tool or person is accounted for;
  • inventory, accounting or audit records, billing, buying, selling or shipping, or any other transaction where the exact quantity matters;
  • legal, regulatory, scientific or other official reporting.

For these uses, verify the count yourself or use a counting method suited to the purpose. Counting guides and tips in the app are general information and may contain errors that sound confident. You use results at your own discretion and risk.

04Accounts

Link to section: Accounts

You don’t need to sign up to use SnapCount. The first time you open the app, a guest account is created automatically so your counts can be saved.

  • You can create an account with your email address and a password. Your existing counts stay with your account, and you can sign in to it on another device.
  • Without an email account, your counts are tied to your guest account on your device and may not be recoverable if you lose access to it.
  • You’re responsible for keeping your password secure and for activity under your account.

You can delete an email account in the app under Profile › Account › Delete Account. To delete a guest account or all of your data, follow the steps on our Support page.

05Your Content

Link to section: Your Content

“Your Content” means the photos, notes, collection names and messages you submit to SnapCount. You keep any ownership rights you have in Your Content.

You give Nexdev a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display Your Content, and to share it with our service providers, including our AI providers, only as needed to operate and provide the Service to you. We don’t use Your Content to train AI models. This licence ends when you delete Your Content or your account, except for copies kept for a limited time in backups as described in our Privacy Policy.

You’re responsible for Your Content and confirm that you have the rights needed to submit it.

Results generated for you

Subject to these Terms, you may use the counts and exports SnapCount generates for you for any lawful purpose, including in your business. Because results are generated by AI, others may receive similar results. General counting guides are shared across the Service and don’t contain Your Content.

06Photo Rules

Link to section: Photo Rules
  • Only upload photos you took yourself or have the right to use.
  • Photos should show the objects you want counted. Only include people when you’re allowed to, and avoid documents, screens and other personal information.
  • Don’t upload content that is illegal, sexually explicit, violent, hateful or harassing, or that infringes anyone’s rights.

Photos are processed as described in our Privacy Policy, including by third-party AI providers. We may remove content or restrict access if we reasonably believe it violates these Terms.

07Acceptable Use

Link to section: Acceptable Use

You agree not to:

  • use SnapCount in a way that breaks any law or infringes anyone’s rights;
  • present SnapCount results to others, such as a customer, buyer or authority, as a certified count, measurement or audit;
  • copy, modify, distribute, sell or lease any part of the Service, or reverse engineer it or try to extract its source code, except where the law allows;
  • access the Service or its servers other than through the app, including with bots, scrapers or other automated means, or use it to build a competing product or dataset;
  • get around subscriptions, usage limits or security features, or share paid access in ways these Terms don’t allow;
  • interfere with or disrupt the Service, its servers or networks, or upload malware;
  • use the Service in a way that violates the terms of our AI providers, such as trying to generate harmful content;
  • impersonate anyone, or misrepresent your connection to any person or organization.

We may set reasonable limits on use to protect the Service and prevent abuse.

08Intellectual Property

Link to section: Intellectual Property

The Service is owned by Nexdev or its licensors and protected by intellectual property laws. This includes the app, its design, software, text, counting guides, graphics, logos and the SnapCount name. These Terms don’t give you any rights to our trademarks.

Subject to these Terms and the Standard EULA, you may use the app on Apple devices you own or control, for your personal purposes and for the internal purposes of your business.

If you believe content in SnapCount infringes your rights, contact us at support@nexdev.codes. If you send us feedback or suggestions, we may use them without any obligation to you.

09SnapCount Pro Subscriptions

Link to section: SnapCount Pro Subscriptions

SnapCount is free to download. Counting objects and the features that rely on counts require SnapCount Pro, which is offered as auto-renewable subscriptions:

  • SnapCount Pro Weekly — renews every week.
  • SnapCount Pro Yearly — renews every year.

The subscription name, length, price and what’s included are shown in the app before you buy. Prices may vary by country and include any taxes where required.

  • Payment. Payment is charged to your Apple Account at confirmation of purchase. We never receive your payment card details.
  • Automatic renewal. Your subscription renews automatically for the same length and at the current price unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
  • Managing and cancelling. You can manage or cancel your subscription in your App Store account settings at any time (see Cancellation).
  • Free trials. We don’t currently offer free trials. If we offer one in the future, its length and the price that applies afterwards will be shown before you start it, and it will convert to a paid subscription unless you cancel at least 24 hours before it ends.
  • Price changes. We may change subscription prices. Apple will tell you about a price change as its rules require, and you can cancel before the new price applies.
  • Refunds. Purchases are processed by Apple, and refund requests are handled by Apple under its policies at reportaproblem.apple.com. This doesn’t affect any rights you have under applicable consumer law.
  • Restoring purchases. Your subscription is linked to your Apple Account. You can restore it on another device or after reinstalling the app with Profile › Settings › Restore Purchases.

10Cancellation

Link to section: Cancellation

You can cancel your subscription at any time in your App Store account settings: open the Settings app, tap your name, then Subscriptions › SnapCount. In SnapCount, you can also go to Profile › Settings › Manage Subscription.

Cancelling stops future renewals. Your access to SnapCount Pro continues until the end of the period you’ve already paid for. Deleting the app or your SnapCount account doesn’t cancel your subscription.

11Apple App Store Terms

Link to section: Apple App Store Terms

If you downloaded SnapCount from the Apple App Store, the following also applies:

  • These Terms are between you and Nexdev only, not Apple. Nexdev, not Apple, is solely responsible for SnapCount and its content.
  • Apple has no obligation to provide any maintenance or support services for SnapCount. Contact us for support.
  • If SnapCount fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to SnapCount.
  • Nexdev, not Apple, is responsible for addressing any claims by you or any third party relating to SnapCount or your use of it, including product liability claims, claims that it fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that SnapCount or your use of it infringes their intellectual property rights, Nexdev, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms when using SnapCount.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, have the right to enforce them against you.

12Disclaimer of Warranties

Link to section: Disclaimer of Warranties

To the fullest extent permitted by law, SnapCount is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

In particular, we don’t warrant that counts, estimates, confidence scores or other results will be accurate, complete or reliable, or that the Service will be uninterrupted, secure or error-free.

Some jurisdictions don’t allow certain warranties to be excluded, so some of these exclusions may not apply to you. Nothing in these Terms affects consumer rights that can’t be waived under applicable law.

13Limitation of Liability

Link to section: Limitation of Liability

To the fullest extent permitted by law, Nexdev and its affiliates, officers, employees and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of, or inability to use, the Service, including any decision you make based on AI results.

To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the amount you paid for SnapCount Pro in the 12 months before the claim.

These limitations don’t apply to liability that can’t be limited or excluded by law, such as liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.

14Termination

Link to section: Termination

You can stop using SnapCount at any time by deleting the app, and you can delete your account or ask us to delete your data. Remember to cancel any subscription separately.

We may suspend or end your access if you seriously or repeatedly breach these Terms, if the law requires it, or if we stop providing the Service. Where reasonable, we’ll tell you in advance.

When your access ends, your right to use the Service stops, and your data is handled as described in our Privacy Policy. Sections that by their nature should continue to apply will survive, including the AI Counting Disclaimer, Intellectual Property, Disclaimer of Warranties and Limitation of Liability.

15Changes to the Service

Link to section: Changes to the Service

We’re continually improving SnapCount. We may add, change or remove features, change the AI models or providers we use, or set reasonable usage limits. Results for the same photo may therefore change over time.

We may also suspend or discontinue the Service, in whole or in part. If we discontinue the Service while you have an active subscription, refunds are handled in line with Apple’s policies and applicable law.

16Changes to These Terms

Link to section: Changes to These Terms

We may update these Terms from time to time. We’ll post the updated version on this page and change the “Last updated” date. If the changes are material, we’ll notify you in the app or on this page before they take effect and, where the law requires it, notify the app stores and ask for your consent. If you keep using SnapCount after the changes take effect, you accept the updated Terms.

17Governing Law and Disputes

Link to section: Governing Law and Disputes

These Terms are governed by the laws of the country where Nexdev is established, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in the courts of that country where the law allows. Nothing in these Terms limits those rights.

Before starting a formal dispute, please contact us at support@nexdev.codes so we can try to resolve the issue informally.

18General

Link to section: General
  • If any part of these Terms is found unenforceable, the rest stays in effect.
  • These Terms, together with our Privacy Policy and, where it applies, Apple’s Standard EULA, are the entire agreement between you and Nexdev about the Service.
  • You may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger or sale of assets, as long as your rights aren’t reduced.
  • If we don’t enforce a right, that doesn’t mean we waive it.
  • These Terms may be provided in several languages. If a translation conflicts with the English version, the English version prevails to the extent permitted by law.
